Blue Eagle Shop is an on-line store administered by the company INVOCATION Inc. These General Conditions of Sale govern the sale of products between INVOCATION Inc and you. Please read these conditions attentively before giving an order. By ordering on Blue Eagle Shop, you notify us of your agreement to being subjected to the following conditions.
1. HOW TO ORDER
If you wish to purchase one or more products listed on the Website, you must select each product you wish to purchase and add it to your cart. When you have selected all the products you want to buy, you can confirm the contents of your cart and place the order.
At this point, you will be redirected to a page summarizing the details of the products you have selected, their prices and the delivery options (with the relevant delivery charges). You will then be asked to choose the delivery options and the shipping and payment methods that suit you best.
Taxes and customs fees are at your charge depending on the destination country when your package arrives.
*Please note: Customs fees and taxes are at your charge upon arrival of the package, they are not included in the shipping costs even if you have a free shipping option. They correspond to approximately 30% of the price of your order and this since January 2021.
A refused parcel will be refunded only after deduction of the transport costs and this, for all the options which we propose.
The transport costs will be deducted from your payment in case of withdrawal and this even if you had taken the free delivery option because a returned package is still charged to the exporter. The above conditions stipulate that you must pay in advance to receive your package.
NB – You must pay the direct cost of returning the product(s) if you cancel your order when it has already been sent, or when the package has been returned to us for lack of payment of customs fees or for lack of having been received by you.
After placing your order, we will send you a confirmation message. We inform you that your items have been shipped. However, you have the possibility to modify your order until the date of shipment of your items.
At this stage you will be redirected towards a page recapitulating the details of the products you selected, their price and delivery options (with the shipping cost). You will then have to choose what delivery option you want as well as the methods of sending payment which are convenient.
You then have to click on the purchase button to confirm and place your order.
Having placed your order, we send you confirmation of purchase. We will inform you when sending your purchase. You have nevertheless the possibility of modifying your order before the shipping date by calling the office at + 1 418 843 8777.
You agree to receiving the invoice of your purchase electronically.
2. RETRACTION POLICY
The delivered products remain the property of INVOCATION Inc until their pick up by the carrier.
3. 14 DAY RIGHT OF RETRACTION, EXCEPTIONS IN the RIGHT OF RETRACTION, OUR RETURN POLICIES WITHIN 30 DAYS
LEGAL RIGHT OF RETRACTION
Unless one of the exceptions listed below is applicable, you can retract your order within 14 days without stating motive from the date in which yourself, or a third party appointed by you (other than the carrier), physically took possession of purchased items. If the invoice includes the delivery of several items delivered separately, the delivery of the last item is the first day for the 14 days of right of retraction.
You have to notify us of your decision to retract your order. You can make an on-line demand according to the instructions and available forms with our customer service at firstname.lastname@example.org.
To respect the deadline of retraction, you just have to send your request before the period of 14 days expires and send back your product.

EFFECTS OF RETRACTION
We shall reimburse you all payments which we received for your order including the expenses of standard delivery (corresponding to the cheapest rate available) in 14 days from the reception of your demand for retraction. We shall use the same means of payment as the one that you used during your initial order, unless you agree expressly to a different means. In any case, this refund will not cause additional costs for you. We may postpone the refund until we received the returned product (s) or until you have supplied proof of the expedition of product (s), the first one supplied will be considered.
Please note that you have to send back the product (s) by following the instructions of our customer service at the latest 14 days from the date to which you notified us of your retraction decision.
The cost of sending back your returned items are at your expense. You will be responsible for the depreciation of the value of said products resulting from manipulations (others than those needed to establish the nature, the characteristics and the proper functionalities of said product [s].
EXCEPTIONS IN the RIGHT OF RETRACTION
The right of retraction does not apply in:
- The delivery of products which cannot be returned for reasons of hygiene or health protection if you have unsealed them or mixed in a inseparable way with other articles.
- the delivery of audio and video recordings or computer software unsealed after delivery;
- the delivery of products which were made according to your specifications or customized or personalized;
- the supply of products susceptible to deteriorate or to expire quickly;
OUR RETURN POLICY UNDER 30 DAYS
Without prejudice to rights due to you as stated by the law, INVOCATION Inc proposes the following returns policy.
All the products from the Blue Eagle Shop web sites can have returned within 30 days following the reception of products from INVOCATION Inc if products are complete and in a new and intact state. For all media packed under plastic or sealed [for example, CDs, books, or hygiene and beauty products], we shall take them back only if they are still in their plastic packaging or if they were not unsealed. Products must have returned by means of our customer service. This is not applicable to ebooks or mp3.
If you send back a product according to our return policy, we shall reimburse you the price which you paid but not the shipping expenses of your initial purchase. Similarly, the risks linked to the transportation and the expenses of return delivery will be at your expense. This return policy does not affect your rights recognized by the law, including your legal right of retraction describes above.

4. PRICES AND AVAILABILITY
All prices are final with Canadian taxes unless otherwise specified.
We display the availability of the products which we sell on the web site on every page. We cannot give more info on the availability of the products that what is indicated on the aforementioned page or somewhere else on the web site. While processing your order, we shall inform you as soon as possible by e-mail by using the email address associated with your information transmitted during your order. If products that you ordered turn out to be unavailable, we shall not charge you for these products.
In spite of all our efforts sometimes there is an error on the pricing. We shall verify the prices when processing your order and payment. If it turns out that we made an error on the display of the price, and that the real price is superior to the posted price on the Internet site, we can contact you to ask if you wish to buy the product at its real price or if you prefer to cancel your order. If the real price is lower than the posted price, we shall charge you the lowest amount and we shall send you the product.
When you order products on Blue Eagle Shop to be delivered outside Canada, you can be subjected to custom fees and taxes on the import, which are collected when the parcel arrives at the destination. New fees at customs clearance will be at your expense; we have no control over these expenses. The customs policies differ from a country to another. You are responsible in contacting your local import and customs for more information. Please note that when you place an order on Blue Eagle Shop, you are considered as the official importer and have to respect all the laws and the regulations of the country in which you receive products. The protection of your private life is important for us and we draw the attention of our international customers to the fact that cross-border deliveries may be opened and inspected by custom authorities.
6. OUR RESPONSIBILITY—GUARANTEE
You benefit from a legal guarantee in conformity to the conditions in articles L.217-4 and following of the Consumer code and from the guarantee of latent defects in the conditions foreseen in articles 1641 and following of the civil code.
When you act in accordance with this legal guarantee,
- you benefit from a period of two years from the issue of the goods to act;
- you can choose between repair or replacement of goods, subject to the conditions of cost foreseen by the article L.217-9 of the consumer code;
- for any product bought before March 17th, 2016 at 11:59:59 pm, you are responsible for producing the proof of the existence of the defect of goods for six  months following the issue of goods;
- for any product bought before March 18th, 2016 at midnight, you are responsible for producing the proof of the existence of the defect of goods within twenty four  months following the issue of goods;
The legal guarantee applies independently of the commercial guarantee.
We decline any responsibility in the hypothesis where the delivered article would not respect the legislation of the country to which its being delivered.
We do our utmost to uphold the excellence of our profession for the goods or services offered to the customer. Nevertheless, our responsibility cannot be retained in case of delay or breach to our contractual obligations if the delay or breach is due to a cause outside of our control: case of force majeure or extreme circumstances such as defined by the applicable law.
Our responsibility will not be engaged in the case of delay due to a shortage of stock. Our responsibility will not be engaged in cases of minor differences between the photos of articles and texts posted on the Blue Eagle Shop web site, and the delivered products.
We implement all the means with which we can ensure our services that are the objects of the present General Conditions of Sale. We are responsible for any direct and predictable damage at the time of the use of the Internet site or for the conclusion of the sale contract between us and you. Within the framework of our relations with professionals, we shall incur no responsibility for losses of earnings, commercial losses, losses of data or loss or any other indirect damage which were not predictable at the time of the use of the Internet site or the conclusion of the sale contract between us and you.
The limitation of above-mentioned responsibility is not applicable in case of deception or of serious offence on our part, in case of physical injury or responsibility because of defective products, in case of eviction and in cases of nonconformity.
7. APPLICABLE RIGHT
The present Terms of service are subjected to the Canadian laws on contracts of international sale of goods. You, as we, agree to subject all the disputes caused by the commercial relations existing between you and us in the nonexclusive competence of Canadian jurisdictions, which means that for the application of the present General Conditions of Sale, you can institute an action to defend your consumer rights in Canada.
8. MODIFICATION OF SERVICE OR GENERAL CONDITIONS OF SALE
We reserve the right to make changes to our Internet site, our procedures, and our terms and conditions, including the present General Conditions of Sale at any time. You are subjected to the terms and the conditions, the procedures and General Conditions of Sale current when you order a product from us, except when a change in these terms and conditions, or the present General Conditions of Sale is required by an administrative or governmental authority. If one of these conditions in these General Conditions of Sale is not considered valid, or not applicable, whatever is the reason, this condition will be considered separately and will not affect the validity and the effectiveness of the remaining conditions.
